Terms of Service

1. Who We Are

Legendary Tales Club is a brand of Legacy Vantage LLC, a Tennessee limited liability company ("we," "us," or "our"). We operate the subscription service available at legendarytales.club. We generate and deliver personalised bedtime stories to parents and caregivers via email.

These Terms of Service ("Terms") govern your access to and use of our website, account dashboard, and email delivery service (collectively, the "Service"). By creating an account or subscribing, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

The Service is intended for use by parents, guardians, and gift-givers on behalf of children. You are responsible for all activity that occurs under your account.

3. Accounts

You are responsible for keeping your login credentials confidential. Notify us immediately at support@legendarytales.club if you suspect unauthorised access to your account.

You may not share your account with others or use the Service on behalf of someone else without their authorisation.

4. Subscriptions and Billing

4.1 Plans

We offer monthly and annual subscription plans. Current pricing is displayed on our pricing page. All prices are in US dollars.

4.2 Trial Period

If we offer a free trial, you will not be charged until the trial period ends. Your payment method will be billed automatically at the end of the trial unless you cancel beforehand.

4.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

4.4 Price Changes

We may change subscription prices. We will give you at least 30 days notice of any price increase by email. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

4.5 Payment Processing

Payments are processed by Stripe. Your payment information is transmitted directly to Stripe and is not stored on our servers. Stripe's terms and privacy policy govern payment processing.

4.6 Failed Payments

If a payment fails, we will attempt to retry the charge. If payment cannot be collected after reasonable attempts, your subscription may be paused or cancelled and access to the Service may be suspended.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time from your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. You will continue to receive stories until that date.

5.2 Refunds

We do not offer refunds for partial billing periods. If you cancel an annual plan, we will not refund the unused portion of the year. Exceptions may be made at our sole discretion for documented technical failures on our part that prevented delivery of the Service.

6. The Service

6.1 What We Provide

We use AI to generate original, age-appropriate bedtime stories personalised to the child profile(s) you create. Stories are delivered by email at the delivery time you configure.

6.2 No Guarantee of Delivery Time

We make reasonable efforts to deliver stories at your configured time. However, we cannot guarantee exact delivery times due to email provider delays, generation queue load, or technical issues outside our control.

6.3 Story Quality

Stories are generated by AI and calibrated for age-appropriateness, narrative arc, and variety. We do not guarantee that every story will meet your personal expectations. If you receive a story you consider inappropriate, contact us and we will review it.

6.4 Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency fixes that temporarily affect availability. We will communicate planned downtime where reasonably practicable.

7. Child Profiles and Personal Information

7.1 Information You Provide About Children

To personalise stories, you may provide us with information about your child, including their name, age, interests, and optional details such as the names of pets or friends. You represent that you have authority to provide this information and to do so on behalf of the child.

7.2 Minimum Age of Children

The Service is designed for children aged approximately 2 to 12. We do not knowingly collect personal information about children directly. All account holders and data providers must be adults (18+).

7.3 Data Handling

We handle personal data in accordance with our Privacy Policy, which explains what we collect, why, and how you can request deletion.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or extract our story generation logic or prompts
  • Resell, sublicense, or redistribute stories or access to the Service without our written permission
  • Provide false information when creating child profiles
  • Use the Service in a way that interferes with other users or our infrastructure

We reserve the right to suspend or terminate accounts that violate these rules.

9. Intellectual Property

9.1 Stories

Stories generated for your account are provided for your personal, non-commercial use. You may read them aloud, save them, and share them with family. You may not republish, sell, or use them for commercial purposes without our written permission.

9.2 Our Platform

All rights in the Legendary Tales Club platform, branding, website, and software are owned by us or our licensors. Nothing in these Terms transfers any intellectual property rights to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components, or that stories will be accurate, appropriate for every child, or suitable for any specific purpose.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEGENDARY TALES CLUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain liability exclusions. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Legendary Tales Club and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

13. Third-Party Services

The Service relies on third-party providers including Stripe (payments), Resend (email delivery), Cloudflare (infrastructure), and Anthropic (AI generation). We are not responsible for the actions, failures, or terms of these providers. Links or references to third-party services do not constitute endorsement.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, cancel your subscription before the effective date.

15. Termination

We may suspend or terminate your account if you violate these Terms, if your payment fails and cannot be resolved, or if we discontinue the Service. We will give you reasonable notice where practicable.

If the Service is discontinued entirely, we will provide at least 30 days notice and a pro-rata refund of any prepaid subscription fees.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee. You consent to personal jurisdiction in those courts. Before filing any claim, please contact us at legal@legendarytales.club so we can try to resolve it informally.
